Join us for this month's education webinar! It will be a Zoom panel discussion, presented jointly by the Chartered Institute of Arbitrators (Canada Branch) and the Canadian Journal of Commercial Arbitration (CJCA).
The topic topic tracks the trend in Canada of increasing court challenges to the sufficiency of arbitral awards. What is driving this phenomenon … Parties who just can’t accept a loss? Outside counsel padding their bills? A misperception that challenges are appeals by another name? Or are arbitrators shirking their duty to write fully reasoned awards? Our panel, made up of experienced lawyers and arbitrators, will discuss this trend from different perspectives and will offer some advice as to best practices for “challenge-proofing” awards.
This event is intended for outside and in-house counsel and arbitrators.
Introducing the topic will be Lisa Munro, of Lerners LLP and the Arbitration Matters blog, who has written a year-in-review of Canadian case law for the forthcoming issue of the CJCA.
Discussing the topic will be three distinguished panellists:
